1. General Provisions
These Terms of Service ("Terms") govern the purchase, download, and use of software products ("Products") provided by KSCode ("we", "us", "our") through our website and any associated services. By purchasing, installing, or using our Products, you agree to be bound by these Terms.
2. Age Requirements
By registering an account and using our Products, you represent that you are at least 13 years of age (or the minimum legal age in your country of residence to use online services without parental consent). If you do not meet this requirement, you must not use our Products.
3. Intellectual Property, User Content & Feedback
Product Ownership: KSCode retains all rights, title, and interest in and to the Products, including all intellectual property rights. These Terms do not grant you any ownership rights to the software.
User Content: You retain all ownership rights to any data, projects, or content you create, process, or export using our Products. We claim no ownership or rights over your generated output.
Feedback: If you provide us with any suggestions, feature requests, or bug reports, you grant us the right to use and implement such feedback without any obligation, compensation, or restriction.
4. License Grant
Free Edition: We grant you a non-exclusive, non-transferable, revocable license to use our Products free of charge for personal, non-commercial purposes. We reserve the right to modify, limit, or remove features of the Free Edition at any time without prior notice. The license is personal and may not be resold, sublicensed, or transferred to third parties. Commercial use requires purchase of a Pro license.
Pro Edition: Upon successful payment, we grant you a non-exclusive, non-transferable, lifetime license to use the purchased Product. "Lifetime" refers to the lifecycle of the Product, meaning you can use the software for as long as we continue to support it and maintain our license validation servers. Each license may be activated on up to three (3) devices simultaneously, unless stated otherwise. The license is personal and may not be resold, sublicensed, or transferred to third parties.
5. Acceptable Use and Restrictions
Under this license, you may not: (a) modify, translate, adapt, or create derivative works from the Products; (b) decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Products; (c) bypass, disable, or defeat any technical copy protection or license validation mechanisms.
6. License Activation & Validation
Free Edition: Our Products may periodically check for updates by querying an external repository (e.g., GitHub). No online license validation is required for the free edition.
Pro Edition: Products require periodic online validation of your license key. The validation process sends a device identifier to our servers. You are responsible for maintaining internet connectivity sufficient for this validation. Failure to validate within the grace period may result in limited functionality.
7. Payments & Taxes
All payments are processed securely by Stripe. Prices are displayed in your selected currency at the time of purchase and may exclude applicable taxes. Any required local taxes (such as VAT or Sales Tax) will be calculated and clearly displayed during the checkout process. The final amount charged may vary due to exchange rates. Upon successful payment, license keys are delivered to the email address associated with your account.
8. Refunds and Right of Withdrawal
By purchasing a Pro license and agreeing to these Terms during checkout, you expressly consent to the immediate delivery of digital content (the license key) and acknowledge that you thereby lose your statutory right of withdrawal (refund). Consequently, all sales are final. Exceptions may be made solely at our discretion; please contact us if you encounter critical issues.
9. Software Updates, Support & End-of-Life
We may release updates, bug fixes, and new features at our discretion. We are under no obligation to provide updates, new versions, or technical support for any specific period. We reserve the right to cease development, support, and maintenance of any Product at any time without prior notice (End-of-Life).
10. Service Availability & License Servers
We strive to maintain high availability of our license validation servers, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or permanently discontinue license validation services at our sole discretion. In the event of permanent service discontinuation, we will make reasonable efforts to provide at least 60 days' notice and may release a final update to remove online validation requirements, though we are not legally obligated to do so.
11. Termination
We reserve the right to suspend or terminate your account and revoke your license key(s) immediately, without notice or refund, if we determine that you have violated these Terms (e.g., by attempting to circumvent license checks, reverse engineer the software, or share license keys publicly).
12. No Warranty
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the software will meet your specific requirements, operate uninterrupted, or be error-free.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KSCODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR BUSINESS INTERRUPTION. Our total liability for any claim shall not exceed the amount paid for the specific Product (or £10 for free editions).
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. However, if you are a consumer residing in the European Union, you may also enjoy the protection of the mandatory consumer protection provisions of the law of your country of residence.
15. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated via our website. Continued use of our Products after changes take effect constitutes acceptance of the revised Terms.
